Software - computer programmes are also an intellectual property (IP). Intellectual property protection of software is complex due to the nature of IP legislation. Software is combination of copyright, industrial property, trade secrets and methods not protected by IP law. Authors of software use a software licence as a legal instrument governing the distribution and use of the their work. Now let's have a look at software categorization. 
We can distinguish two main types of software based on their openness.
  1. Proprietary software
  2. Free open source software
